Legal Question in Family Law in Virginia

Being pregnant before getting married

I got pregnant in October 2002. I got married on a whim on November 14,2002 and seperated two days later, do I have to wait 6 months or one year before I can be divorced?

In Virginia, six months, if no children, one year, if child(ren), from the date of separation of the spouses, which must be continuous and without interruption from that date.

This sounds like one of those questions with which law school professors attempt to stump law students. :-)

The answer is six months, so long as there are no children involved other than the one you are carrying. You may also want to ask your attorney whether there are any factors in your life that would make seeking a judicial annulment of the marriage a better option, and whether your marriage would qualify.

Good luck!
