Legal Question in Family Law in Virginia

We are in the process of adopting our 1 2year old son. He is from Oregon and we live in Virginia. He was sexually abused by his old foster brother. The foster brother is in police custody and a trial is pending. We do not want our almost adopted son to have to testify at this trial which will involve making him go back to Oregon which he is deathly afraid of. Can the court system make us bring him back to oregon to testify even if we feel it will be detrimental to our son?

Probably not, but a lawyer should likely review any paperwork which may be issued by Oregon authorities such as a witness subpoena to secure your son's presence in that jurisdiction for the pending trial.
