Legal Question in Family Law in Virginia

What is the process to legally change my child's last name? My son is five and I have not had any contact with the father for over four years. He has never paid child support but did not sign over his rights. I live in Virginia and the last known address I have for his father is in Texas.

File what's called "A Petition for Name Change of a Minor Child"

in your local circuit court(civil division). You may be able to pick up a packet

of forms with instructions on how to do it on your own without

an attorney or, if not available there, you may be able to download it from

the court's website.
