Legal Question in Family Law in Virginia

Proof of Allegations

Recently my wife filed for a divorce.

In her petition she accuses me of adultery and bed and board abandoment even though we were intimate until the day she left our residence. Question: Will she or will she not have to prove the accusations to the court.

Re: Proof of Allegations

Yes, your wife will have to prove these accusations against you by a preponderance of the evidence if she expects to secure a divorce from you on the so-called fault grounds(adultery and abandonment) which she has apparently alleged in her complaint.
