Legal Question in Family Law in Virginia
Property of a deceased relative
In April of this year, my ex-husband died suddenly leaving no will. His brother and sister gave our son (15 yrs. old)
the vehicle that their brother was driving at the time of
death. The vehicle had out-of-state license plates (that has already expired) and I contacted that state to find out how to have the vehicle transferred to me. We could find no paperwork for the vehicle (title, registration. Last week I found out there is a lein on the vehicle and the lein holder wants the vehicle back. The vehicle is not drivable and I want to know what my rights are and what I must do at this point. I am concerned that I may be fined in the county that I live for having the vehicle parked on my property and need to know what I must do to protect my self.
Thank you

Re: Property of a deceased relative
With regards to this vehicle, you have no rights whatsoever. Your son, apparently, received it as a
gift subject to the rights and interests of the lienholder.
Contact the lienholder and tell them to come and retrieve the vehicle by a certain date or you will
have no alternative but to dispose of it yourself.
