Legal Question in Family Law in Virginia

Property Settlement

I have 2 acres of land which my mother gave to me only, not my husband & I. She gave it to me as a deed of gift. I was married at the time she gave me the land. I have obtained a mortgage all in my name. My husband built the house himself. The property is now worth $250,000. My loan amount was much lower. Because my husband did all the work himself we have built up a lot of equity. We have been living there for about a year. If we were to ever get divorced, I would want to keep the house because the land has been in my family for many years. Could you please tell me what he would be entitled to?

Re: Property Settlement

Your husband very definitely has a claim to what now is clearly marital property. Without much more detailed information regarding the nature and extent of his labors, time, and, possibly,

money expended on his part in improving the property, there would be no realistic way to calculate the equitable share he might be entitled to in the event of a divorce.
