Legal Question in Family Law in Virginia

property settlement agreement

My husband wants me to live in the marital home for 2 yrs and get one of the 4 vehicles we own. He wants me to have his name off of mortgage in 2 yrs. If I don't he will move back in the house and I have to move out. What happens if I refuse to agree with his terms? Can his lawyer force me to sign the property settlement? I want to sell the house, but the value of the house is less than what we owe the bank.

Re: property settlement agreement

No, noone, including your husband's lawyer, can force you to sign a property settlement agreement.

Some version of this question has been previously posted to which I commented that I thought that this proposal as described would essentially prove to be an unworkable agreement and should therefore be avoided.

Since the house is apparently a so-called "under water property", it will probably go to foreclosure

since neither you nor your husband will likely be able to sell it.
