Legal Question in Family Law in Virginia

Question pertaining to Family Law in Virginia

I got a divorce 10 years ago. Part of the divorce agreement was child visitation agreement. My ex continues to violate the visitation agreement, therefore I filed a petion with the court to have the visitation modified. After getting served, she went to her local Courthouse(in a different State), and filed a petition to have just the visitation part of our divorce decree moved to the County/State where she now resides. Have you ever heard of a Court moving just a portion of a case from one juridiction to another?

Re: Question pertaining to Family Law in Virginia

Yes, that could be possible if your child is now subject to the jurisdiction of that other state with respect to visitation and custody issues, which the child would be if he or she has been in residence there continuously at least six or more months immediately preceding the filing of the mother's petition.
