Legal Question in Family Law in Virginia

I just had a question about taking my son on a out of state vacation. Me and his father have joint with me having physical and i have a vacation planned for next month to take my son to florida. His father was post to go but we recently stopped trying to work things out, if i still take my son out of state for the vacation can his father get charges or anything on me or am i allowed to take him still?
