Legal Question in Family Law in Virginia

I recently discovered that my mother and father's marriage may possibly be void. They were married in 1972 in New York, but her divorce from her first husband wasn't finalized until 1988. She passed away in 2004. Is there anything that can be done in regards to securing her assets that my father received because unless I'm wrong, technically (and legally) he wasn't her husband. Is there a time limit on such actions?

Yes, the one (time limit) called laches would seem at the very least to apply

to this situation (in my opinion).
