Legal Question in Family Law in Virginia
I am recently retired U.S. Navy Chief after 22 yrs of service on 31 Oct 2010. I filed for divorce from my wife in the state of Virginia Beach, VA last April 2009 when we were married for 18 1/2 yrs. As of Nov 17, 2010 we have been married for 20 yrs. We have 4 children together ages 18, 15, 8 and 6. All reside with her. I had been providing her with support based on the Navy's Support of Dependents guidelines/recommendations of 3/5 of gross pay and BAH for spouse and 2 or more children without a court order since Aug 1999. My 18 yr old is attending college at TCC and living with her mother. I was paying $1,300 on the 1st each month and $780.57 on the 15th. I am paying the mortgage on the 15th each month which is $684. I am working with my lawyers at Kauffman and Canoles law firm in Virginia Beach, VA. They are currently awaiting for me to replenish my trust account with $950 before proceeding further in my case for a settlement conference, meeting with judge and court proceedings. I am currently awaiting my next and new civilian employment, unknown at this time. My monthly retirement pension is about $1900 so currently what should I (what should be expected) be providing to my still spouse and 4 children to prevent neglecting my responsibility as a father/husband? Please advise what my bi/monthly payment should be currently?
