Legal Question in Family Law in Virginia

Relocating to Europe

My wife and I have agree to an informal separation. She currently resides in North Carolina and I live in Bahrain. We are both US citizens and have two children (ages 6 and 3). The children live with my wife in NC. She recently told me that she would like to relocate to Ireland or London, England to be with her new boyfriend. My question is-- can she do so without my consent? In addition, if we decide to pursue a formal separation, will she be able to move the children overseas -- assuming she has full custody?

Re: Relocating to Europe

Yes, she can do it without your consent as long as there's no valid court order now in place to prevent it.

Once there is at least a PSA(Property Settlement Agreement) in effect between the parties, then she would need to comply with the terms of such an agreement in regard to moving the children to some overseas venue which likely would include some advance notice requirement to you, their father.
