Legal Question in Family Law in Virginia

Relocation, and health insurance

I have sole custody of our 4 year old daughter. Her father has visitation set as summer and alternating holidays.

I reside in VA and have since divorce. He moved immediately to NY, and from there has moved to MI and within that state with out notice to the court.

We split travel costs, as I thought it would be petty to go back to court over his moving and travel costs.

I plan on relocating out of VA in about a year. What factors do I need to be aware of in order to be successful? I do not think he will object, but wish to be prepared regardless.

Also, the father is ordered to provide health coverage and chooses not to. Since our daughter has repiratory ailments, I have gained coverage for her. I was formerly in the military and this was cost effective. Having gotten out, it is $400.00 a month. What recourse have I in this?

Thank you for your consideration and time.

Re: Relocation, and health insurance

I don't see any credible objections which your former husband could have regarding your proposed move out of state(if that's what you're asking about). After all, he's moved to Michigan without, apparently, properly informing the Virginia court of his change of residence, and whether you moved to anywhere in the U.S. within a 1000 miles of Virginia, what difference could that possibly make to him with respect to his current residence in Michigan?

Re: Relocation, and health insurance

The father should not only be paying for the child's health care coverage that he was ordered to provide in the final decree of divorce but also at least half the cost($200 per month)of her monthly respiratory treatments.
