Legal Question in Family Law in Virginia

Relocation with sole custody

I have sole custody of our 6yr old son. I'm still single- my ex is currently engaged. He has every other weekend visitation with our son and divided holiday visitation. He sticks with the every other weekend visitation - he doesn't ask for anything more. I just finished my bachelor's degree and I've been offered a job as a government contract analyst for a major company. I currently work as a secretary and this job opportunity offers more stability, and a more secure financial furture for both my son and I. The job is in Dallas,TX. I don't want to take our son away from my ex, but I also want to move on with my life. It's not a option for me to leave our son here. He's the reason why I've worked so hard to make something of myself and to have more. I want to work it out that he sees our son during the summer breaks and christmas holidays. What do I need to do - I want this to be as painless as possible. I'm gong to speak with my ex also, but if he disagrees, then what? Are the courts reluctant to allow parents with physical custody to relocate with the child? Am I stuck in this state forever? I'm not trying to erase my ex out of our son's life, I just want to make a better life my son and I. Pls advise. Thank you!

Re: Relocation with sole custody

The courts are likely to rule in your favor. Being that you are offered a more stable job, they will find it in the childs best interest for you to move. Do you have a current child visitation order? You may have to advise your ex that you are moving 30 days beforehand. Good luck!
