Repeal

I had posted a question before ''Final Order of Adoption'' asking if my adoption might be at risk because of a new alleged punitive father. VA code 63.1-219.23 (Final order not subject to attack after six months) was discussed. Our six months has passed since our final order was entered. Now our BMom is reconciling with this other supposed birthfather and we have been told they will join forces to try and get the baby back. In re-reviewing this VA code, I've noticed that this has been added: ''Repealed effective October 1, 2002''. I'm not quite sure what it means when a code is repealed. Does it mean that our adoption is still final because we passed the six months after finalization before Oct. 1st? Or does this mean that our adoption can be reopened and vulnerable to attack?

Your first interpretation of the Code is the correct one.This newly- surfaced putative father will not be able to attack or bring under question the validity of your Final Order of Adoption.
