Legal Question in Family Law in Virginia

Request for modification of child support with DCSE

I am under a CONSENT circuit court order to pay a certain amount as child support. My ex has opened a case with DCSE to collect the child support. I lost my job and cannot pay the consent order amount. Can I request a review with DCSE to adjust the child support OR must I file a motion with circuit court to reduce the child support? I am inclined to go with DCSE because I have no income to pay the attorney. Will going with DCSE preserve my rights for a reduction?

Re: Request for modification of child support with DCSE

Yes, you could arrange for an interview with a DCSE caseworker to present your case for the modification of your order. And, if they agree that the circumstances warrant such modification, the DCSE attorney would probably file a motion with the circuit court to have the order revised, accordingly.
