Legal Question in Family Law in Virginia

Requesting A New Guardian Ad Litem

A Guardian Ad Litem was appointed for my two sons (6&4) They are to make a recommendation for custody and visitation. We had a court date last month which was continued to the 30th of this month. The reason being because the GAL did not give me any paperwork and they did nothing about custody. Since then they have only spoken to me on the phone making it a total of 3 times. However they have gone to my exs home and spoken to her, the children, and her boyfriend. They have not spoken to my fiance or seen my interaction with the children. I live out of state so I can understand not coming to my home but I have visits with the children in Virginia and they could see my interaction with them there. I do not understand how they can make a recommendation about custody if they have not talked to all the parties involved and have not even witnessed how my children change. When they are around me they are loving and say I love you. As soon as my ex comes around they are afraid to say those words as she has tried to keep me away from them and brainwash them. I feel the GAL is not doing their job. Would I need to request a new one now or do so at the court date next week stating my reasons as to why. And would this be reasons for a new one?

Re: Requesting A New Guardian Ad Litem

Most GAL's do a great job and nothing in your email indicates the GAL is doing a poor job. I suppose you could request a meeting with the GAL and go see them. Good luck.
