Legal Question in Family Law in Virginia

I am a resisent of VA but was married in Canada. We have been legally separated for close to nine years and I was wondering if I have to retun to Canada to file and obtain my divorce.

No, assuming that you've been a domiciliary (resident) of the Commonwealth for 12 months or more, you can initiate your divorce action from Virginia without the necessity (not to mention bother) of returning to Canada.

Michael is correct, though I respectfully correct my learned brother -- you have to have been resident and domiciled in Virginia for only 6 months.
