Legal Question in Family Law in Virginia

After School Care Cost

My ex's first child is 15, we have a common child who is 8. My ex calculated in our child support the afterschool care for our child, can she do that? Her 15 year old is in the house, can she be with our child since she is old enough? Can she really make me to pay for the afterschool care?

Daycare expense necessary for the custodial parent's employment is allowed to be factored into the child support calculations under the

Virginia Child Support Guidelines. If this afterschool care can

be fairly considered under this factor, then it would be allowed (in my opinion).

See Va. Code Sec. 20-108.2 for further information.
