Legal Question in Family Law in Virginia

I am separated from my husband. We have two children who live with me and for whom he provides no support. I have petitioned the court to establish custody of the children and the hearing is scheduled for the end of next month. However, I have lost my job and am facing eviction. My immediate family resides out of state (FL) and I would like to relocate there. Can the court grant permission for me to leave prior to the hearing and return on that date?

You do not need to obtain the court's permission to leave the state(assuming there are no prior orders requiring such permission or notice of your intent to leave) and then to return on the date scheduled for the hearing. (However, if you do fail to appear on the date set for the hearing, your petition will likely be dismissed.)
