Legal Question in Family Law in Virginia

I have been separated from my husband in Virginia for 18 mos. after 38 years of marriage. When he retires will I be eligible for half of his total retirement of VRS funds and TIAACref?

Any property acquired during the marriage is marital property (except for gifts and inheritance) and you are entitled to a share of it. VA is not a community property state but in most cases the assets are divided equally between the two of you. Now keep in mind that you won't receive the VRS funds until he retires but you can receive the TIAACref at the time of divorce.
