Re: Is a separation ever considered a divorce?
No, in the Commonwealth, a separation does not magically "morph" into a divorce merely because the parties have lived separate and apart for x number of years. Only a court of proper jurisdiction can bring about a divorce, after the
appropriate papers have been filed, costs paid, the opposing party properly served, and whatever hearings that are necessary on the matter have been held.
