Separation

Husband and wife are currently in marriage counseling, situation not working out. We both agree we should separate and work out problems. Wife will keep 11 year old, 2 other daughters away at college. Husband says he has no where to go. Current household was given to wife from another family member, husband was put on deed once we got married back in 1994. Wife and child do not really want to leave and find somewhere else to live, husband keeps saying he has no where else to go. How do we resolve this situation? wife does not want any any charges with abandonment if separation leades to divorce later on.

I would not recommend leaving the home, especially since your daughter is staying with you. Probably the best thing to do would be to execute a Stipulation Agreement and at the same time your husband can leave the marital home. Be aware that he may have an interest in the marital home depending on his contributions. I recommend that you see an experienced family law attorney concerning your situation.
