Legal Question in Family Law in Virginia

separation prior to divorce/alimony timeframe

I left a bad marriage after one month, and it's been four months since then. She says that I must wait six months before I can file for divorce. The question is,after six months separation from this short lived marriage,is she entitled to alimony? as an aside: She has been convicted of a crime recently that occured prior to the marriage.

You ask should "she", meaning your spouse, of course, be entitled to alimony, after marital togetherness approximating one month.

I would say no.

Alimony is subjective and is based on her need for it and your abilty to pay it taking into consideration the length of the marriage. One month marriages usually dont yield any support.

Good luck
