Legal Question in Family Law in Virginia

separation

I have separated from my husband, he doesnt want to divorce but there is no way I can continue with the marriage. He does not want to go through attorney or the court. I agreed to a mediator but he asked for us to go to counseling. He has control over our savings and our home..I feel like he is dragging everything out in order to hide money. He insist that I continue to help pay credit card bills. We have a minor child that he has no interest in. How do I file for separation ?

There is no legal status in the Commonwealth recognized as "legal separation" You should probably retain the services of a competent divorce counsel to initially file a complaint in your behalf in circuit court for what's called pendente lite support and maintenance for yourself and the child along with a request that you be awarded the right to occupy the marital home.
