Legal Question in Family Law in Virginia

Separation/Divorce

We have been separated for over 7 years, he never signed the separation papers so the divorce needs to be refiled. I just recently found this out when I took him to DCSE and was notified that the Pendente Lite was no longer in effect. We have come to an agreement on child support and all other issues. What would be the easiest and cheapest way for us to get a divorce? Will the 7 years suffice apart suffice, eventhough it was not a ''legal'' separation--or will we have to wait for another year? Thanks!

Re: Separation/Divorce

You do not need to file for "separation". All that is required to file for divorce is living separate and apart for a year. This fact must be alleged and proven in order to divorce.
