Legal Question in Family Law in Virginia

I am seperated for four months and I still live with my husband and his parents We have a son 29 months and we all live in one bedroom condo , not to mention that my mother in law lays on bed suffering cancer I want to go and file for custody at the court but I would appriciate your advice Living there is a torture for me and not healthy for my son.

You don't need to file for formal custody of your son since the law already recognizes you as the child's natural guardian by virtue of your being his mother.
