in a seperation agreement if both parties cannot agree upon who to get the property- how will the property be settle?

The parties may wish to attempt mediation, in which a trained mediator assists the parties to come to agreed decisions concerning the property. The mediator does not make any decisions, but acts as a vehicle to get the parties to agree.

If mediation is not desired or unsuccessful, the parties have access to the Circuit Court in their jurisdiction to determine what property there is between the parties, who has title to the property, whether the property is classified as separate or marital, the value of the property and the equitable division of the property.
