Seperation laws for the state of virginia

In the state of Virginia after one year or more of seperation from your spouse are you legally seperated with out filing the seperation?

In Virginia law there is no distinct marital status recognized as "legal separation".

However, many spouses who have separated and are, perhaps, contemplating divorce, file what's known as a Separation And Property Settlement Agreement.

No. You have to actually file for a divorce from bed and board to be separate. You can file for a final divorce within 6 months of separation if you have no children and one year of separation if you have children.
