Legal Question in Family Law in Virginia

Seperation time limits

My wife and I had a Legal Seperation doccemnet drawn up over 5 years ago. She moved out of the residence, and I am not able to locate her now to finalize a divirce. Is there a time limit that allows me to file for a divorce if I do not know here whereabouts?

Re: Seperation time limits

There is no time limit as to when you can file a divorce. You can file for a divorce and serve her by a notice of publication if you cannot find her. You must get court approval to publish by testifying that you have used your best efforts to find her. Publishing for four weeks in a paper of national distribution costs about $500 these days. Your lawyer will know what to do.

Good luck
