Legal Question in Family Law in Virginia
seperation
my wife and i are going to seperate under the auspicies of hoping it gives us some time to chill and maybe change so that we can hopefully get back together at a later time. she has seen a lawyer, but no official seperation papers have been drawn yet. she wants me to move out and rent an apt. somewhere. we want this to be amiable, but i am wondering if i am opening myself up to future problems by leaving the house. we both own it. what restrictions or freedoms do i have if i am the one to leave. Is this a bad decision?

Re: seperation
It can be a bad idea. I would advise that you meet with an attorney to discuss the particular facts in your case, and how your interests can be best protected. Although you are separating with the hopes of getting back together, you are nonetheless separating and must protect your rights in your marriage/property. Your wife's attorney is representing your wife--not you--and you cannot expect he/she will be looking out for you.
