Legal Question in Family Law in Virginia

Hi, I am trying to serve my 3 yr old son's father since last Aug. However I cannot since he is a contractor in Kuwait. Do you know if I can serve his attorney or mother since she is in charge of all his legal issues (divorce). His current wife(soon to be ex) has also called me to inform me of their divorce court hearing date and that I might be able to serve him, that is if he has to attend. I am just trying to figure out a way to serve him:(, thanks.

If the attorney is representing him in your domestic relations matter,

(whatever it may be), he should be willing to accept service of the papers. If not,

the attorney would be unlikely to accept service. Forget about the mother;

she is not legally qualified to accept service of process (irrespective of what

she may allegedly be in charge of).

However, if the referenced attorney declines to accept service, you may have to

petition the court to permit constructive service on your husband, i.e.,

publication regarding your lawsuit in a local newspaper for successive weeks.
