Legal Question in Family Law in Virginia

Settlement agreement

My husband deserted me after 4 years. I have considerable real estate in my maiden name and a couple of properties that were paid for by me but both names are on the deeds. Can a settlement agreement be simply made by me and signed by him.

Re: Settlement agreement

In order to remove your husband's names from the deeds he will need to quitclaim(by executing quitclaim deed) voluntarily his interests in the properties back to you. These actions cannot be accomplished merely by a separate settlement agreement between

the two of you.

Furthermore, if the properties were jointly held by the two of you as tenants by the entireties, additional executions may be required about which you would be well advised to consult with appropriately knowledgeable counsel.
