Legal Question in Family Law in Virginia

Settling custody

It is my understanding that in VA you have to apply for custody in court otherwise the noncustodial parent can take that child and never return the child. I want to know if you can agree to custody out of court and if so how to you make it legal so it will hold up in court? Thank you for your time.--name removed--

Custody arrangements between cooperating parents

must be incorporated in the form of a court order in order to be enforceable.

Anything less will lack the enforceability that can only be conferred by a bonified court order.
