sexual relationships before divorce is final

Husband filed for divorce on the grounds of adultry. There are two minor children involved and during the waiting period the had the boyfriend around the children and even had him spend the night in their apartment. The year waiting period is final and the mother has the boyfriend staying the weekends with them and also stay the weekends at his home in another state. The boyfriend and his wife are being investigated by the FBI for a variety of crimes. How far could the father take these issuses in the custody matters? The mother has full custody now. Does it matter now that the year is up but the divorce is not final ?

If the divorce is not yet final, neither are the permanent custody issues, and the husband's attorney should be looking into any matters which might reflect adversely on the mother's fitness to have permanent custody of these children and be ready to present them to the court at the appropriate time(and before the divorce is finalized.)
