Legal Question in Family Law in Virginia

''Sleep Overs''

My 6 year old daughter spends every other weekend with her father, who lives in Maryland. Just this weekend his new girlfriend spent the night & was still there in the morning when my daughter awoke. My daughter also said ''she slept in Daddy's bed.'' Is it illegal for her father to have a non-married woman sleep over with him, while my in front of my daughter?

It's not illegal, just a real bad idea.

Exposing a child to an intimate relationship outside of marriage is grounds for withdrawal of visitation if the offending party continues such conduct.

It is important that you make it clear to the father that you do not approve such conduct and will ask the court to remedy the situation if he does not do so voluntarily.

Illegal no. Immoral yes. Should you bring a Motion to Amend the Court Order and present evidence of this overnight, the Judge will forbid it or change the arrangement to punish the father.

Good Luck.
