Legal Question in Family Law in Virginia

Small Claims Court

My divorce lawyer filed a lien on my home sale for $200 more than I owed him. May I file a complaint for this small an amount? It's more about the principle than the amount. I have corresponded with him personally and have filed for arbitration both of which he's refused to answer directly. Thank you.

Re: Small Claims Court

Yes you may appear in small claims court. Also, should you be unable to work out the situation with the attorney directly, and have specific complaints regarding his representation, you may wish to consult the State Bar.

Re: Small Claims Court

You may go to small claims court but I would let the bar complete its review. If you have a valid complaint they will encourage the attorney to settle with you.
