Legal Question in Family Law in Virginia

I have sole legal and physical custody of my 15 month old son. His father has never even met him once and he is not on the birth certificate. I just recently found out I have a fairly serious illness and am trying to get all of my affairs in order. I have a lesbian life partner who is basically my son's other mother and when I pass away I want to ensure that he stays with her. My main question would be: In the state of Virginia, can I file papers with the court to request that my partner have joint custody of my son with me now?

Sure, you can file your petition but that in no way assures that

your request will be granted as in the best interests of the minor child.
