Legal Question in Family Law in Virginia

My son (military) and daughter-in-law reside in Virginia and she wants to separate and go back to her home town in New Mexico. They have a 2 year old son that she plans on taking with her. Can she take him out of state?

If there is no prior court order she can leave with child. But I would advise obtaining a custody, visitation, and support order to avoid future problems.
