Legal Question in Family Law in Virginia

Can my son mother get me for kidnapping if neither one of has no kind of custody of our son, and i went and picked him up and brought him back? Is a great chance i can get custody of my son? especially if he's living conditions is horrible, as far as she stay with her mother and 2 brothers and 1 sister in a small house. along with she's not taking him to the doctor, she's always asking for money for herself, then she hasn't gotten my son circumcised i told her to go get it done and it's free, but she consist on telling me she needs money for when i already told her where to go. neither her or her mom cannot keep the power on, she called me telling me that our son bout died cause the power was cut off in alabama. she puts her feeling s in the way of our son well being. i was wondering if you can assist me in filing for sole custody, i will like for her to have visitation rights, but i goal is to get my son full time so he can be properly taking care of!

If your son resides with his mother in Alabama, your petition for custody

would need to be filed in the city or county of that state where they

currently reside.

The same would apply if the two are residents of the Commonwealth, with

the petition most likely being filed in the local J&DR;Court where they currently

live. (It's not clear from your question the state in which they are they currently residing, i.e., Alabama or Virginia?)
