Legal Question in Family Law in Virginia
My son turned 18 on 10/2/09. My divorce agreement has the standard wording for child support:
Must be a full time high school student
Must be living at home
Must not be self supporting
My son chose to attend a community college instead of finishing 12th grade in HS. He is only doing one HS credit and the rest are college credits. He only attends college part time and works when he is not in college.
I believe my child support can stop based on the above - am I correct?

You would need to petition the court having proper jurisdiction over this issue for a ruling on the matter and to have your support order vacated, if appropriate. (You should not assume that your support order automatically terminates based upon your interpretation of the relevant facts and law that may apply to this particular situation.)
