Legal Question in Family Law in Virginia

My son and his wife have a troubled marriage. they have a 4yr old daughter. my son is out of town on bussiness. his wife threatened that he would never see his daughter again. i'm afraid his wife is sending our grandaughter to stay with her mother while he is out of town. what legal rights does my son have?

Right now, apparently in the absence of any court order relating to the matter of custody, your son has the same rights as his wife in regard to your granddaughter.
