Legal Question in Family Law in Virginia

My son (13yo) has legal custody with his mother. however by his choice and mother agreement he's been living with me for over 2 years, Now Im leaving the state, (Virginia) he does'nt wish to return with his mother, I discussed with her, she agree for my son to leave with me. I'm not seeking custody at this time, so I requested a legal document ( a power of attorney, affidavit) from his mother stating that I'm legally entitled to travel and take full care of my son. needless to say, Im still waiting for the document. Is there any way or how can I do this without getting in a custody fight?

No, not that I am aware of if the custody matter is already within the jurisdiction

of the appropriate Virginia Court.
