Legal Question in Family Law in Virginia
My sons father live out of state and i have full physical custody. My son is only 8 months old, one day his dad wants him in his life the next day he wants to relinquish his rights. As the noncustodial parent can he take my son out of state for his two day visitation? I never agreed to out of state visitation because I feel he need to build a bond first and our son is way too young. He's only been in his life for three months. I don't trust him b/c hes emotionally and mentally unstable. I had a restraining order at one point of time, he was abusing during my pregnancy and he has a warrant for verbal threats. I just don't know what he will do if he's three hours away and he gets mad. We share joint legal custody and thats it according to the courts visitation will be what we both agree to and he was okay with seeing him on his days off in the state we live in (VA) on his days off. Now he wants to change the agreement and uproot our child to NJ for a day in a half literally. I don't know what to do other than tell him to take me to court because i'm not agreeing to the new changes.

Well, it would appear that you already have your answer to this question, i.e., let
him take you to court if you're refusing these new conditions for his visitation with your eight month old son.
