Legal Question in Family Law in Virginia

My son's father lives in Pa and I live in VA, I have sole legal custody on the child and he has visitaion. My husband wants us to move to Fl. to be closer to his mother who's mind is fading. Can I move with my son? What rights do I have in this matter?

You will need to give the father 30 days written notice of the intended move, during which time he can petition the Court for a change in custody if he believes the move would not be in the best interest of the child. I you and the father cannot work it out by agreement, you would have to convince a judge that the move is in the best interest of the child, a likely probability.
