Me and my sopns mother have 50-50 joint legal and physical custody of my 3 year old son. Is there a motion that the court can stipulate us sharing the filing of my son on our tax returns?

You don't need to involve the court in this issue, i.e., the two of you can merely agree to alternate tax years in claiming the dependency deduction for your

son, as long as the claiming parent can prove(if necessary) that the boy resided in his or her household for more than six months for that particular tax year in

which the deduction is claimed.
