Legal Question in Family Law in Virginia

spousal support to husband

what are Virginias requirements for you to have to pay spousal support to estranged husband? Do I need to counter file paperwork & what kind? Is a judge likely to order me to pay with no income or savings, property etc.?

Re: spousal support to husband

The payment of spousal support(alimony) is not mandatory in the Commonwealth and is normally within the discretion of the court which requires its evaluation of a number of factors in the lives of the divorcing parties to determine whether such an award of alimony is justified in any particular case.

If you have been served with divorce papers by your estranged husband in which he is asking for alimony, you should include in your answer which must be filed within 21 days from the date of service the reasons why you believe there are no grounds for such a request on his part(you have insufficient income, savings, property, less education than he and ability to earn, etc.).
