Legal Question in Family Law in Virginia

Spousal Support

6 yrs. ago spousal support was terminated by court order based on cohabitation. Now person is trying to sue for back spousal support saying Judge was wrong in his decision. The court order was never appealed. I thought an appeal had definitely to be made within a time frame or appeal rights were lost. This involves a separation agreement that was incorporated into a divorce decree.

When someone is following a court order and a letter from lawyer saying they do not have to make any further support payments, how can they be sued for breach of contract.

Re: Spousal Support

The person can still be sued, however, that doesn't mean that the suer will win anything.
