In the State of Virginia during a divorce, can you subpoena your soon to be ex's cell phone records including his texts? Also, can you subpoena the person who he is having an affair with cell phone records and text messages?

Yes, if a Complaint for Divorce has actually been filed in the circuit court and the subpoenas are issued in the course of the pretrial discovery process

or in securing witnesses for the trial of the case.
