Legal Question in Family Law in Virginia

Im in the state of virginia. My husband and I seperated, we are still married and have not filed for divorce yet, we have a child togather. He kept the child during the move out process because he was staying in the apartment we lived in togather while i found another place to live. He told me i needed to move. I have now found a place its been about 1 month since the split and he refuses to let me have my child, i was the primary parent during the marrige as he was either at work, at his girlfriends house or drunk. He is only keeping our child because he knows of the upcoming custody battle and is trying to make himself look like the care giver. I know its a show but the court might not. If i get my child back from him will i be able to keep him until custody has been granted.

How could anyone here in this forum (or elsewhere) reliably

answer this question since you give no indication as to

how you would get the child back in your physical custody

absent an order from a court having proper jurisdiction over

the matter or whether you've even actually filed

for custody in the appropriate Virginia court?
